What Happens During Probate in Georgia?

Probate is the legal process used to administer certain assets after a person’s death.

Depending on the estate, the process may involve submitting a will to the appropriate probate court, appointing a personal representative, identifying and protecting assets, addressing valid debts and expenses, handling applicable tax matters, and distributing remaining property to beneficiaries or heirs.

Not every asset necessarily passes through probate. Trust assets, certain jointly owned property, and accounts with valid beneficiary designations may transfer outside the probate estate.

Probate When There Is No Will

If someone dies without a valid will in Georgia, they are considered to have died intestate.

Georgia law generally determines who inherits probate property, and the probate court may appoint an administrator to handle the estate.

Intestate estates can become complicated when there are multiple heirs, blended families, real estate, business interests, or disagreements about how the estate should be administered.
